2. The Competitions
2.1. These Terms and Conditions, together with the Privacy Policy and any applicable Policy and/or Rules, and Special Terms as may be introduced from time to time, set out the complete scope of the Promoter’s obligations and liabilities to you in respect of all Competitions made available on the Promoter’s Website, and together constitute the agreement between You and the Promoter for each Competition. In the event of any inconsistency between these documents, they shall take precedence in the following order: (a) any applicable Special Terms (highest priority); (b) these Terms and Conditions; and (c) any other policy. If any provision (or any part of a provision) within these documents is determined by a court of competent jurisdiction to be void and/or unenforceable, such determination shall apply only to that specific provision (or part thereof) and shall not render the remaining provisions void or unenforceable.
2.2. An entry fee is payable each time you enter via our Online Entry Route. Alternatively, you may enter via the Postal Entry Route as detailed in section 3.5 below .Each person who enters either via the Online Entry Route or the Postal Entry Route is an Entrant for the purpose of these Terms and Conditions, provided they meet the eligibility requirements set out in section 6 (including the requirement to be aged eighteen (18) or over).
3. How to enter
3.1. Each Competition shall commence from the time it is made available on the Website and shall continue until the closing date specified therein. These dates shall be referred to as the sales open date and the sales end time respectively. All times and dates referenced are based on the time zone in England. Times displayed on the Website may reflect Your device settings, but England time shall prevail. The Promoter will use reasonable endeavours to allow a reasonable period for the collection of Entries, the selection of the Winner, and the announcement of the result. This provision does not impose any fixed or guaranteed timeframe and is subject at all times to the Promoter’s rights under sections 11 and 12.
3.2. Where it is strictly necessary due to circumstances outside the Promoter’s control, and where failing to do so would result in unfairness to individuals who have already entered the Competition, the Promoter reserves the right to amend the Sales End Time or rectify any incorrectly displayed Sales Open Date on the Website. In the event that the Sales End Time of a Competition is amended, the updated details shall be made available on the Website. It is Your responsibility to make sure of a Competition’s details on the Website.
3.3. All Competition Entries must be received by the Promoter no earlier than the Sales Open Date and no later than the Sales End Time. For the avoidance of doubt, the Online Entry Route will not accept Entries made after the Sales End Time and such Entries will be disqualified and will not be included in the relevant Competition. Any Postal Entries received by the Promoter after the Sales End Time will not be included in the relevant Competition, as further provided in sections 3.5.2 and 3.5.3. No refund will be provided in respect of a disqualified entry, except where required by applicable law or where the disqualification results from an error, fault, or failure attributable to the Promoter.
3.4 To enter a Competition using the Online Entry Route:
3.4.1. You may enter a Competition via the Online Entry Route by complying with the following conditions:
(a) you must hold a registered Account on the Website and be logged in at the time of entry;
(b) navigate to the relevant Competition page on the Website and select Your desired number of entries;
(c) ensure that all personal details provided are accurate, complete, and up to date;
(d) A minimum cart value of GBP 5 applies at checkout and may be satisfied by a bundle of Competition entries selected by You across two or more different Competitions made available on the Website, whether such Competitions carry different entry prices, relate to different Prizes, or have different Sales End Times or Competition Dates. Provided that the aggregate value of the selected entries in the relevant transaction is not less than GBP 5, You may spread that minimum amount across multiple current Competitions offered on the Website.
(e) proceed through checkout, submit the online entry form, and finalise payment prior to Sales End Time in order to receive an order confirmation and Your allocated ticket number(s) by email; by submitting an entry, you confirm that you satisfy the eligibility requirements set out in section 6 and agree to be bound by these Terms and Conditions.
(f) The Promoter will send a confirmation email once Your entry is complete. If you cannot find the email, please check Your junk or spam folder and ensure that the email address associated with Your Account is correct. You should log in to Your Account at any time to view Your allocated ticket number(s), which shall serve as confirmation of a valid Entry.
3.4.2. By creating an Account, and purchasing Competition entries, you enter into a contract with the Promoter and agree to be bound by these Terms and Conditions.
3.5 To enter a Competition using the Postal Entry Route:
3.5.1. You may enter the Competition at no cost via the Postal Entry Route (“Free Entry”) by complying with the following conditions:
(a) you must hold a registered Account on the Website
(b) Submit Your entry on an unenclosed postcard sent by first or second class post to the Promoter at Got2Win, Unit 167992, PO Box 6945, London, W1A 6US. Each postcard should contain one entry only;
(c) The postcard must contain only Your personal free entry code and the Promoter’s address made available on the Website. No Personal Identifiable Information (PII) must be included on the postcard. The code must be written or printed in clear, legible block letters and numbers. Any code that is illegible will be discarded and will not be processed;
(d) Entries that are incomplete or illegible will be disqualified;
(e) No limit applies to the number of entries submitted via the Postal Entry Route, subject to any maximum number of Competition Entries specified on the relevant Competition page of the Website. Each Postal Entry Route submission must be completed and sent to the Promoter separately. Where multiple entries are submitted together in a single envelope or package, the Promoter will treat them as a single entry.
(f) By entering the Competition, you confirm that you meet the eligibility requirements and agree to be bound by these terms and conditions;
(g) The Promoter will send a confirmation email to each Entrant who has submitted a valid entry into a Competition via the Postal Entry Route. Competition If the email cannot be found, Entrants should check their junk or spam folder and ensure that the email address associated with their Account is correct. Entrants should log in to their Account to view their allocated ticket number(s), which shall serve as confirmation of a valid entry.
(h) Entrants must have an Account registered on the Website for the Postal Entry Route to be processed.
3.5.2. Any Postal Competition Entry received after the specified Sales End Time on the relevant Competition page of the Website will not be processed and will not be entered into the relevant Competition. However, the Promoter may, in its sole discretion, allocate such a late Entry, or any other Postal Competition Entry that would otherwise be invalid for a Competition, to the next available suitable Competition. No Entrant shall be entitled to such an allocation, and the Promoter shall have no obligation to make one.
3.5.3. The Promoter accepts no responsibility and shall not be liable for any Competition Entry submitted via the Postal Entry Route, or any scanned or digitised record of such Competition Entry, that is not received, is received late, or is lost, delayed, damaged, destroyed, stolen, or misdirected in the course of postal transmission, whether or not such failure is attributable to any act or omission of Royal Mail, any such third-party provider, or any other cause beyond the Promoter's reasonable control. For the avoidance of doubt:
(a) proof of posting shall not constitute proof of receipt by the Promoter, and the Promoter shall be under no obligation to investigate the non-receipt of any postal entry;
(b) it is the sole responsibility of the Entrant to ensure that their Competition Entry is posted in sufficient time to be received and processed by the Promoter prior to the Sales End Time, having regard to the ordinary delivery times of the postal service used;
(c) the Promoter shall not be required to notify an Entrant that their received postal Competition Entry has been disqualified under these Terms and Conditions;
(d) subject to section 3.5.2, no refund, credit, compensation, or alternative entry shall be provided in respect of any Competition Entry that is not received by the Promoter by reason of any of the circumstances described in this section 3.5.3.
(e) subject to section 3.5.1, a valid Competition Entry submitted via the Postal Entry Route shall only qualify for the relevant Competition with effect from the date on which it is received and processed by the Promoter, and not from the date of posting.
(f) subject to compliance with these Terms and Conditions, a Competition Entry submitted via the Postal Entry Route shall have equivalent status to a Competition Entry submitted via the Online Entry Route for the purposes of the conduct of the Competition, the selection of the Winner, and the allocation of the Prize.
(g) the Promoter shall be entitled to rely on the timestamps, scanned records, and processing records generated by it or by any third-party provider engaged to receive, scan, digitise, or process Competition Entries submitted via the Postal Entry Route as reasonable evidence of whether, and when, a Competition Entry was received, processed, and verified as compliant;
(h) the receipt of a postcard by the Promoter or any such third-party provider shall not of itself constitute a valid Competition Entry, and a Competition Entry submitted via the Postal Entry Route shall qualify for the relevant Competition only once it has been received, processed, and verified by the Promoter as compliant with these Terms and Conditions and any applicable Competition Rules; and
(i) where a Competition Entry submitted via the Postal Entry Route but at the time it is received, processed and verified by the Promoter in accordance with these Terms and Conditions, the maximum number of Competition Entries specified on the relevant Competition page of the Website has already been reached, or the relevant Competition has otherwise sold out, that Competition Entry shall not qualify for, and shall not be entered into, the relevant Competition. For the avoidance of doubt, a Competition Entry submitted via the Postal Entry Route is only treated as received for the purposes of entry once it has been physically received by the Promoter and processed by the Promoter in accordance with these Terms and Conditions, and not at the time of posting. The Promoter reserves the right not to accept any such Competition Entry, notwithstanding that it may have been posted or may have arrived before the Sales End Time, where the maximum number of Competition Entries for that Competition has already been reached at the time of receipt and processing. As the Postal Entry Route is a Free Entry carrying no monetary value, no refund, credit, compensation, reimbursement of postage, or alternative entry shall be due in respect of any such Competition Entry.
4. Choosing a winner and allocation of outcomes
4.1 Competitions
4.1.1. All Entrants who have validly entered a Competition in accordance with section 3 above shall be included in a draw. Prizes are awarded in accordance with the laws of chance, and the Winner will be selected through a verifiably random selection process. Valid free Entries submitted through the Postal Entry Route and valid paid Entries submitted through the Online Entry Route shall be treated identically for the conduct of the draw, the selection of the Winner, and the allocation of the Prize. The random draw shall take place on the Competition Date, which may differ from the Sales End Time. The Competition Date will be specified on the relevant Competition page of the Website.
4.1.2. If a Competition is disrupted for any reason or results in an inconclusive outcome, we reserve the right, at our sole and absolute discretion, to conduct the draw again, whether using the same random selection process or an alternative method.
4.1.3. Subject at all times to the Promoter’s rights under section 12.4 to void, suspend, cancel, or amend a Competition, and to reallocate entries or refund entry fees where a Competition is cancelled, each Competition shall take place on its scheduled Competition Date regardless of the number of Competition Entries received or the proportion of available tickets sold. Accordingly, the Promoter is under no obligation to sell any minimum number of tickets or Competition Entries in order for a Competition to proceed. The Promoter will not delay, cancel, or otherwise affect a Competition by reason only of some or all of the available tickets remaining unsold at the Sales End Time. For the avoidance of doubt, this section does not limit the Promoter’s right under section 12.4 to void, suspend, cancel, or amend a Competition where circumstances beyond its reasonable control make such action necessary.
5. How Competitions are conducted
5.1. All Competitions will be conducted by the Promoter using a random number generation software programme ("RNG Software"). The RNG Software will be used to generate a random number corresponding to a valid ticket number allocated to a Competition Entry received prior to the Sales End Time. The Entrant to whom the corresponding ticket number has been allocated shall be identified as the Winner in accordance with these Terms and Conditions.
6. Eligibility
6.1. The Competitions are open to individuals aged eighteen (18) years or over who are currently resident in the UK and who hold a valid UK postal address for correspondence and prize delivery, excluding:
(a) employees of the Promoter;
(b) employees of the Promoter’s agents or suppliers who are professionally involved in the Competition or its administration; or
(c) members of the immediate families or households of the individuals listed in (a) and (b).
6.2. By entering any Competition, you confirm that you satisfy the eligibility requirements to participate and to claim any Prize you may win. The Promoter reserves the right to request evidence of Your eligibility (see section 12.7). If you do not provide such evidence or any other information reasonably requested by the Promoter within five (5) days of the request, You may be disqualified from the Competition, and the Prize may be dealt with by the Promoter at its sole discretion in accordance with section 9.2.2.
6.3. If, in relation to any Competition, the Winner is disqualified, found to be ineligible, fails to satisfy any eligibility, verification or claim requirement under these Terms and Conditions, cannot be contacted, fails to respond within the period specified by the Promoter, fails to provide any confirmation or information reasonably requested by the Promoter, fails to claim or accept the Prize, or otherwise forfeits entitlement to the Prize in accordance with these Terms and Conditions, the Promoter may, where the relevant Prize is of such nature or value that the Promoter considers it appropriate to do so and subject to any applicable Special Terms, elect in its sole discretion to select an alternate winner from the remaining valid Entries in that Competition by means of a verifiable random draw. Nothing in this section shall oblige the Promoter to select an alternate winner in any case, and where the Promoter does not elect to do so, the Promoter may deal with the Prize in its sole discretion in accordance with these Terms and Conditions. Where an alternate winner is selected under this section, that alternate winner shall, for the purposes of these Terms and Conditions, be treated as the Winner of the relevant Prize and shall be required to satisfy all applicable eligibility, verification and claim requirements within the timeframes specified by the Promoter.
6.4. By entering any Competition, you confirm and acknowledge that Your Entry (whether free or paid) may not be cancelled by You under any circumstances.
6.5. Refunds will only be issued in exceptional circumstances and at the sole discretion of the Promoter. No refund of the entry fee will ordinarily be provided:
(a) where, after entering the Competition, you subsequently determine that you are not eligible to participate or to claim the Prize; or
(b) where you are disqualified from the Competition by the Promoter in accordance with these Terms and Conditions.
6.6. Entrants may enter each Competition multiple times. The maximum number of Competition Entries that may be purchased is subject to any per-purchase limit set by the Promoter and specified on the relevant Competition page of the Website.
7. The Prize
7.1. The details of the Prizes are, to the best of the Promoter’s knowledge, information and belief, accurate as at the Sales Open Date of each Competition as described on the relevant Competition pages of the Website.
7.2. To the fullest extent permitted by applicable law, the Promoter makes no representations or warranties in relation to the Prize, including its value, condition, or any other information provided on the Website. Nothing in this section shall exclude or limit any liability that cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015.
7.3. The Promoter does not represent or warrant that the information made available on the Website is accurate, complete, or current.
7.4. The Promoter reserves the right to replace a Non-cash Prize with an alternative Non-cash Prize of equal or greater value in the following circumstances:
(a) where the Non-cash Prize becomes unavailable;
(b) where other circumstances outside the reasonable control of the Promoter make such substitution necessary, including (without limitation) where the Non-cash Prize or any component of the Non-cash Prize is lost, stolen, damaged, or destroyed prior to delivery to the Winner; where the Non-cash Prize is subject to a product recall or is withdrawn from supply by the relevant manufacturer or Supplier; where delivery of the Non-cash Prize is prevented or materially delayed by reason of a Force Majeure Event; where the Non-cash Prize or any component of it is seized, confiscated, or otherwise made unavailable by any governmental, regulatory, or law enforcement authority; or where any change in applicable law or regulation renders the award or delivery of the Non-cash Prize unlawful or impracticable.
(c) Where the exact colour, trim, specification, model, or other features of a Non-cash Prize (or any component of it) are unavailable from the relevant Supplier or manufacturer at the time of fulfilment, the Promoter reserves the right to provide the Non-cash Prize in an alternative colour, trim, or specification of substantially similar or higher specification and of equal or greater value. Any such variation shall not constitute a replacement of the Non-cash Prize for the purposes of this section 7.4, and the Winner shall not be entitled to any cash payment, refund, or other compensation in respect of any such variation.
7.5. Where a Competition offers a Cash Alternative in respect of a Non-cash Prize, the Website will prompt the Entrant, at the time of entering that Competition and selecting the cash option, to enter valid bank account details in the name of the Entrant for the purpose of processing any Cash Alternative payment should the Entrant be selected as the Winner. It remains the Entrant’s responsibility to ensure that any bank details provided are accurate, complete, and kept up to date, and the Promoter shall not be responsible for any incorrect information provided by the Entrant. The provision of bank details at the time of entry does not discharge the Winner’s obligation to provide accurate and correct bank details in accordance with sections 7.6(d), (e) and 7.7, and does not affect the five (5) calendar day period referred to in section 7.6 (e), the position that at the sole discretion of the Promoter no additional time will be given, or the Promoter’s right to award the Non-cash Prize (or a substitute Prize) as the default, as set out in those sections.
7.6. The Prize is non-negotiable and non-transferable, save that the Promoter may, in its sole discretion or where expressly stated on the relevant Competition page of the Website or in any applicable Special Terms, offer a Winner a Cash Alternative in place of a Non-cash Prize. Where a Cash Alternative is offered by the Promoter and accepted by the Winner, the Winner must first reply to the Promoter’s communication with acceptance and acknowledgement that:
(a) the Winner elects to accept the Cash Alternative in place of the relevant Non-cash Prize;
(b) payment of the Cash Alternative shall constitute full and final settlement of the Promoter’s obligation in respect of that Prize; and
(c) upon payment of the Cash Alternative, the Winner shall have no further right, claim, or entitlement to receive the relevant Non-cash Prize or to assert that the advertised Prize has not been provided.
(d) the Winner must provide accurate and correct bank details within five (5) calendar days, such period running from the date on which the Promoter first communicates with the Winner for this purpose. Where the bank details provided by the Winner are incorrect, incomplete, or cannot be used to process the payment, no additional time will be given to provide corrected bank details. If the Winner fails to provide accurate and correct bank details within that five (5) calendar day period, the Promoter reserves the right to withhold the Cash Alternative and, as the default, to award instead the original Non-cash Prize item associated with the same Competition. Where the original Non-cash Prize item is not available or cannot for any reason be awarded (including in any Cash Alternative scenario where the original Prize is unavailable or is otherwise not awarded), the Promoter shall have full and sole discretion to award a substitute Prize of equal or greater value in accordance with section 7.4. In all events, the Promoter shall have full and sole discretion to award the Non-cash Prize as the default where accurate and correct bank details are not provided within the time specified, and payment or delivery of such Prize shall constitute full and final settlement of the Promoter’s obligations in respect of that Prize.
(e) the Winner must provide accurate and correct bank details within five (5) calendar days, such period running from the announcement of the Winner or, where a Cash Alternative is awarded after that date, from the date on which the Cash Alternative is awarded. In all events, the Promoter shall have full and sole discretion to award the item Prize (or such substitute Prize) as the default where accurate and correct bank details are not provided within the time specified, and payment or delivery of such Prize shall constitute full and final settlement of the Promoter’s obligations in respect of that Prize.
7.7. The Promoter shall be under no obligation to pay the Cash Alternative until such response and accurate and correct bank details have been received. Upon receipt of the response and payment of the Cash Alternative, the relevant Non-cash Prize shall cease to be available to that Winner, and the Promoter shall have no further obligation in respect of that Non-cash Prize. If the Winner does not respond to the Promoter’s communication accepting and acknowledging the Cash Alternative, or does not provide accurate and correct bank details, within five (5) calendar days (such period running from the date on which the Promoter first communicates with the Winner for this purpose), subject to the Promoter’s sole discretion, no additional time will be given and the Promoter reserves the right, as the default, to award the Winner the original Non-cash Prize item associated with the same Competition, or, where that item is not available or cannot for any reason be awarded, to award a substitute Prize of equal or greater value in accordance with section 7.4. The Promoter will use reasonable endeavours to process the relevant payment to the Winner within fourteen (14) days of the later of (a) confirmation of the Winner, and (b) the Winner satisfying all applicable eligibility and verification requirements, including the provision of valid bank account details in the name of the Winner under section 12.7.2(iv). This timeframe is a target only and is not guaranteed, and remains subject to sections 8, 11 and 12.
7.8. The Winner shall be responsible for all costs and expenses not expressly included as part of the Prize.
8. Winners
8.1. The Promoter’s decision shall be final, and no correspondence or discussion will be entered into.
8.2. Following the successful conclusion of a Competition, the Promoter may publish or otherwise make available limited Winner information on the Promoter's Website and Social Media Accounts for the purpose of evidencing that a valid award has taken place. The manner in which a Winner's details are displayed will be determined by the display preference selected by the Winner in their Account profile. Winners may select one of the following display options: (a) full name and location (for example, "John Smith, London"); (b) first name and initial of surname with location (for example, "John S, London"); (c) initials and location (for example, "JS, London"); or (d) anonymous participant and location (for example, "Anonymous Participant, London"). Where no preference has been set, the Promoter will default to option (b). Winners may update their display preference via their Account profile at any time prior to publication taking effect in accordance with section 8.13. Notwithstanding any display preference selected, the Promoter shall remain entitled to provide full Winner information and Winning Entry details to the Advertising Standards Authority or any other relevant regulatory authority upon request. Any use of a Winner's image, photograph, video, testimonial, or personal details for marketing or promotional purposes beyond the minimum required to evidence a valid award shall require the Winner's separate prior consent. The Promoter will retain underlying Winner records for as long as necessary to administer the promotion, respond to complaints, evidence valid award, and comply with requests from any regulatory authority, in accordance with Article 5(1)(e) of the UK General Data Protection Regulation and the Promoter's Privacy Policy.
8.3. Following the Competition Date, the Promoter's system will automatically send an email notification to the Winner using the email address associated with their registered Account.
8.4. The winner of a Prize in a Competition will be notified by email and/or by such other means as the Promoter considers appropriate, which may include telephone or any other contact method using the details associated with the Winner's registered Account. The Winner must follow the instructions provided by the Promoter in order to claim the Prize.
8.5. The Promoter will use reasonable endeavours to deliver, or arrange delivery or collection of, the Non-cash Prize within fourteen (14) days of the announcement of the Winner. This timeframe is a target only and is not guaranteed, and remains subject to sections 11 and 12. The Promoter will dispatch the Non-cash Prize to the delivery address held on the Winner’s Account profile at the time of dispatch and shall not be required to contact the Winner to verify or confirm that address. It is the sole responsibility of the Winner to ensure that the address details held on their Account profile are accurate, complete, and kept up to date, and the Promoter shall bear no responsibility for any delay, failed delivery, or non-receipt of the Non-cash Prize resulting from inaccurate, incomplete, or outdated address details.
8.6. Where an attempt to deliver the Non-cash Prize fails, or the Non-cash Prize is returned to the Promoter as undelivered, by reason of the address details held on the Winner's Account profile being inaccurate, incomplete, or out of date, the Promoter shall bear no responsibility for such failure and may, at its sole discretion, use reasonable endeavours to contact the Winner and arrange redelivery or collection of the Non-cash Prize. Where the Non-cash Prize remains undeliverable, the Promoter shall have no further obligation in respect of the Non-cash Prize and shall be under no obligation to provide any payment, refund, or other compensation to the Winner, except where required by applicable law.
8.7. It is the sole responsibility of each Entrant to ensure that all details held on their registered Account, including their full name, contact details, and delivery address, are accurate, complete, and kept up to date at all times so as to enable the Promoter to contact the Winner and deliver or arrange delivery of the Non-cash Prize. The Promoter shall be entitled to rely on the details registered on the Winner’s Account for all purposes connected with notification, verification, dispatch, delivery, or transfer of the Non-cash Prize. Where any such details are inaccurate, incomplete, or out of date, the Promoter may treat the resulting delay, failed delivery, or non-receipt as a failure by the Winner to claim the Non-cash Prize, and the consequences set out in section 8.6 shall apply.
8.8. Where the Prize is a Non-cash Prize, the Promoter may, but shall not be obliged to, contact the Winner to verify, confirm, or update the delivery address held on their Account profile before the Prize is dispatched. The Promoter may dispatch the Prize to the delivery address held on the Winner’s Account profile at the time of dispatch whether or not the Winner has responded to, verified, or confirmed their details in response to any such request. For the avoidance of doubt, the Promoter’s decision whether or not to request confirmation of the delivery address in any given case shall not affect the Winner’s sole responsibility under sections 8.5 and 8.7 to ensure that the address details held on their Account profile are accurate, complete, and kept up to date.
8.9. Where a Cash Alternative is to be paid, the Promoter will contact the Winner to confirm the bank account details in the name of the Winner required to process payment. The Winner must reply to that communication confirming accurate and correct bank account details within five (5) calendar days, such period running from the date on which the Promoter first communicates with the Winner for this purpose. The Promoter may (but shall not be obliged to) use reasonable endeavours to contact the Winner. If the Winner cannot be contacted, reply confirming the requested bank account details, or fails to provide any confirmation requested under section 12.7.4, in each case within that five (5) calendar day period or such other period as may be specified in the applicable Special Terms, the Promoter may, deal with the matter in accordance with section 8.10.
8.10. Where a Winner has elected a Cash Alternative but cannot be contacted, fails to confirm accurate and correct bank account details, or otherwise fails to provide any confirmation requested, within five (5) calendar days of the Promoter first communicating with the Winner (or such other period as the Promoter may specify in the applicable Special Terms), no additional time will be given and the Promoter may, at its sole discretion, withhold the Cash Alternative and award the Winner instead the original Non-cash Prize (or, where that Non-cash Prize is not available or cannot for any reason be awarded, a substitute Prize of equal or greater value in accordance with section 7.4).
8.11. Where the Prize is a Non-cash Prize and the Winner has not elected a Cash Alternative, the Promoter will make reasonable efforts (which shall consist of more than one attempt, using the contact details held on the Winner’s Account profile) to contact the Winner and arrange delivery or collection of the Non-cash Prize. If, despite such reasonable efforts, the Winner cannot be contacted, fails to respond, fails to provide any confirmation or information reasonably requested by the Promoter (including under section 12.7), or otherwise fails to claim or is unable or unwilling to accept the Non-cash Prize, in each case within five (5) calendar days of the Promoter first attempting to contact the Winner (or such other period as the Promoter may specify in the applicable Special Terms), the Promoter may treat the Winner as having forfeited all entitlement to the Prize. Where entitlement is forfeited under this section, the forfeited Winner shall have no right to any Prize, Cash Alternative, compensation, cash equivalent, alternative prize, or refund of any Competition Entry Fee in respect of the forfeited Prize, except where required by applicable law. For the avoidance of doubt, nothing in this section obliges the Promoter to select any replacement or alternate winner, and the Promoter shall remain entitled to provide the relevant Winner information and Winning Entry details to the Advertising Standards Authority or any other relevant regulatory authority upon request.
For the avoidance of doubt, where the Promoter awards the original Non-cash Prize (or a substitute Prize) under section 8.10 in place of a withheld Cash Alternative, delivery of such Prize shall constitute full and final settlement of the Promoter’s obligations in respect of that Prize, and the Winner shall have no right to any Cash Alternative, additional compensation, cash equivalent, or alternative prize, nor to any refund of their Competition Entry Fee, except where required by applicable law.
8.12. Where verification is requested by the Prompter, following successful validation of the Winner's Entry and satisfaction of all applicable eligibility and verification requirements, the Promoter will use reasonable endeavours to dispatch, or arrange delivery or collection of, the Prize within a reasonable period, and will ordinarily aim to do so within fourteen (14) days of such validation. This timeframe is a target only and is not a guarantee, and any such period is subject to sections 8.8, 11 and 12. The Promoter's obligation in respect of delivery of the Prize shall be limited to dispatching or arranging delivery of the Prize to the address registered on the Winner's Account at the time of dispatch, and once the Prize has been so dispatched the Promoter's delivery obligation shall be discharged in full. The Promoter shall not be liable for any delay in, or failure of, fulfilment, or for any failure to receive, collect, or take delivery of the Prize following dispatch, where the same arises from any cause outside its reasonable control, including a Force Majeure Event, Supplier or third-party delay, any inaccurate, incomplete, or outdated delivery address or other details held on the Winner's Account, the unavailability of the Winner at the registered address, the refusal or failure of the Winner to accept delivery, or any act or omission of any postal, courier, or delivery service provider beyond the Promoter's reasonable control. Where the Promoter becomes aware that fulfilment will be materially delayed, it will use reasonable endeavours to keep the Winner informed and to arrange delivery or collection as soon as reasonably practicable.
8.13. Where a Prize is delivered to the Winner in a damaged, defective, or incomplete condition, the Winner must notify the Promoter in writing at support@got2win.co.uk as soon as reasonably practicable, and in any event without undue delay, after delivery, providing reasonable details and, where practicable, photographic evidence of the damage, defect, or shortfall, and must retain the Prize and its packaging to enable the Promoter or the relevant Supplier to inspect or arrange collection. Where the Promoter is reasonably satisfied that the Prize was damaged, defective, or incomplete on delivery, the Promoter shall, at its option and in full and final settlement of its obligations in respect of that Prize, either (a) repair the Prize; (b) replace the Prize, or the affected component, with an item of the same or substantially similar specification; (c) substitute an alternative Prize of equal or greater value in accordance with section 7.4; or (d) where none of the foregoing is reasonably practicable, pay the Winner a Cash Alternative reflecting the value of the Prize as described on the relevant Competition page of the Website. The Promoter shall have no liability in respect of any damage, defect, or deterioration arising after delivery, including any caused by the Winner’s use, storage, handling, or onward transport of the Prize. Nothing in this section limits or excludes any right or remedy the Winner may have that cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015.
8.14. The Promoter is required to either publish or otherwise make available information confirming that a Winner has been awarded a Prize. To meet this requirement, the Promoter will publish Winner information in accordance with the display preference selected by the Winner in their Account profile, as set out in section 8.2. Where no preference has been set, the Promoter will apply the default display option set out in section 8.2. Winners may object to any publication or request a reduced display format by updating their profile preferences in accordance with section 8.2.
8.15. Following the conclusion of a Competition , the result may not be published immediately. The Competition result may remain in a pending state until the Promoter manually publishes it (“Pending State”).
8.16. You are responsible for keeping Your display preferences up to date. The Promoter is not responsible for the display preferences you set prior to winning a prize Competition. For the avoidance of doubt, even where a Winner has selected the anonymous option or has otherwise limited their display preference, the Promoter shall remain entitled to provide the relevant Winner information and Winning Entry details to the Advertising Standards Authority or any other relevant regulatory authority upon request.
8.17. Publicity and Use of Winner Information
8.17.1. By entering a Competition, each Entrant acknowledges and agrees that, if selected as a Winner, the Promoter may invite the Winner to provide any photograph, image, video recording, voice recording, testimonial, statement, or other publicity material relating to the Competition, the Prize, or the Winner’s experience. Where the Winner voluntarily provides any such material to the Promoter, the Winner shall be deemed, by that act, to have consented to the Promoter’s use of that material, together with the Winner’s display preference, likeness, image, voice, and any statements contained in or accompanying it, for advertising, marketing, promotional, and publicity purposes in connection with the Competition and the Promoter’s business, in any media now known or later developed, worldwide, and without further consent, notice, approval, or compensation, save where required by applicable law. In any such use, the Promoter will apply and maintain the display preference selected by the Winner in their Account settings in accordance with section 8.2, and any change made by the Winner to that display preference shall be given effect for future use, save where the Promoter is required to disclose Winner information to the Advertising Standards Authority or any other relevant regulatory authority.
8.17.2. The Winner acknowledges that the Prize is the sole consideration for the rights granted under this section 8.17 and that, to the maximum extent permitted by law, no further payment, royalty, or other compensation shall be due in respect of any such use.
8.17.3. The Promoter may publish or otherwise make available the surname and county of Winners, and the Winning Entry where applicable, where required to comply with applicable advertising rules or legal obligations, including any request from the Advertising Standards Authority or other competent authority.
8.17.4. Any personal data processed under this section 8.17 will be handled in accordance with the Promoter’s Privacy Policy and applicable data protection law. Where consent is relied upon as the lawful basis for any particular publicity use, the Winner may withdraw that consent at any time, provided that such withdrawal shall not affect: (a) the lawfulness of any processing or use carried out before withdrawal; or (b) any processing that the Promoter carries out in reliance on a lawful basis other than consent. Nothing in this section 8.17 affects the Winner’s rights under applicable data protection legislation.
9. Disqualification
9.1. The Promoter reserves the right to disqualify any Entrant and/or invalidate any Entry at any stage of a Competition, including following the announcement of a Winner, in any of the following circumstances:
9.1.1. the Entrant does not satisfy, or ceases to satisfy, the eligibility requirements set out in section 6 of these Terms and Conditions;
9.1.2. the Entry does not comply with the Entry Requirements or these Terms and Conditions;
9.1.3. the Promoter reasonably considers that the Entrant has breached these Terms and Conditions;
9.1.4. the Promoter reasonably considers that the Entrant has acted in coordination with others, or has submitted entries in the name of another individual, with the intention of circumventing these Terms and Conditions or breaching applicable laws or regulations;
9.1.5. the Entry has been generated automatically by computer systems or submitted via agents, third parties, or as part of a syndicate;
9.1.6. the Entry is incomplete, illegible, or otherwise invalid;
9.1.7. it is, or becomes, unlawful for the Promoter to promote the Competition to the Entrant and/or to award the Prize to them;
9.1.8. the Entrant is found to be interfering with or manipulating the operation of the Competition or the Website, or entering by fraudulent or deceptive means;
9.1.9. the Promoter reasonably considers the Entrant's activity to be suspicious, including (without limitation) where the Entrant has used automated tools to submit entries, provided false or unverifiable Personal Details, or is suspected of any financial crime in connection with their participation in a Competition;
9.1.10. the Entrant has posted content on any of the Promoter's social media pages which, in the Promoter's reasonable opinion, is inappropriate, offensive, or otherwise in breach of applicable law;
9.1.11. the Entrant fails to provide evidence of identity, eligibility, or any other information reasonably requested by the Promoter within the timeframes specified in these Terms and Conditions; or
9.1.12. where, in relation to any Competition Entry submitted via the Online Entry Route, the payment used for that Entry is subsequently subject to a reversal, chargeback, cancellation, retrieval request, payment dispute, or other non-payment event, and the Promoter reasonably determines, following such enquiries as it considers appropriate, that: (a) the relevant payment has been reversed, charged back, cancelled, or otherwise not validly received by the Promoter; or (b) the Competition Entry was for some other reason not validly paid for under these Terms and Conditions.
9.2. Where an Entrant is disqualified, the following shall apply:
9.2.1. any entry submitted by that Entrant shall be void and of no effect to any Competition;
9.2.2. if the disqualified Entrant has been selected as the Winner, the Prize will be dealt with in such manner as may be set out in the applicable Special Terms for the relevant Competition. Where no such Special Terms apply, the Promoter may deal with the Prize at its sole discretion, including by selecting an alternate winner in accordance with section 6.3. Where an Entrant is disqualified under this section, that Entrant shall have no right to any Prize, Cash Alternative, compensation, cash equivalent, alternative prize, or refund of any Competition Entry Fee in respect of the forfeited Prize, except where required by applicable law; and
9.2.3. No refund of any Competition Entry Fee will ordinarily be provided to a disqualified Entrant, except where required by applicable law or where the disqualification results from an error, fault, or failure attributable to the Promoter.
9.2.4. Where the Promoter becomes aware of any matter described in section 9.1.12, the Promoter may, pending investigation, suspend the Competition Entry or Competition Entries purchased using the affected payment, withhold any Prize connected with any such affected Entry, and, where reasonably necessary in order to protect the integrity of the Competitions, investigate suspected fraudulent or abusive payment activity or, temporarily suspend the relevant Account. The Promoter may request from the Entrant such reasonable information or evidence as it considers necessary in relation to the disputed or reversed payment and may rely on information provided by any payment processor, payment service provider, card issuer, bank, or other intermediary involved in the processing of that payment. Where the Promoter is reasonably satisfied that the payment issue has been resolved in the Entrant’s favour or that the relevant payment has been validly received, the Promoter may lift any such suspension, release any relevant prize and take no further action.
9.2.5. If, before the Competition Date, the Promoter reasonably determines in accordance with section 9.1.12 that the relevant payment has been reversed, charged back, cancelled, or otherwise not validly received, the affected Competition Entry or Competition Entries purchased using that payment may be cancelled and shall be treated as invalid. Any such affected Entry shall not be entered into, or if already provisionally recorded shall be removed from, the relevant Competition and shall not participate in the draw. For the avoidance of doubt, any other Competition Entries validly purchased by the same Entrant using a different and validly received payment shall remain unaffected unless otherwise disqualified under these Terms and Conditions.
9.2.6. If, after the Competition Date but before the Prize has been delivered, collected, transferred, paid, or otherwise made available, the Promoter reasonably determines in accordance with section 9.1.12 that the Winning Entry was not validly paid for, the Promoter may disqualify the relevant Winner in respect of that affected Entry, and withdraw or withhold the Prize, and may select an alternate winner in accordance with section 6.3. Any such action shall apply only in respect of the affected Winning Entry and shall not, by itself, invalidate any other unrelated valid Entries held by that Entrant.
9.2.7. If, after the Prize has been delivered, collected, transferred, paid, or otherwise made available, and the Promoter reasonably determines in accordance with section 9.1.12 that the Winning Entry was not validly paid for, the Promoter may require the Winner to return the Prize, and the Winner shall, upon written request, provide reasonable cooperation in relation to such return. Where return of the Prize is not reasonably possible, or where the Prize has materially depreciated, been consumed, transferred, or cannot reasonably be recovered in kind, the Promoter reserves the right to seek recovery of the reasonable value of the Prize actually lost by the Promoter, together with the unpaid Competition Entry Fee to the extent legally recoverable.
9.2.8. Nothing in sections 9.1.12 or 9.2.4 to 9.2.7 shall: (a) prevent an Entrant from raising a legitimate chargeback or genuine payment dispute; (b) limit or exclude any statutory rights of an Entrant; or (c) exclude or restrict any liability or remedy which cannot lawfully be excluded or restricted.
9.3. The Promoter's decision to disqualify any Entrant shall be final and binding, subject to any mandatory rights the Entrant may have under applicable law. The Promoter shall not be obliged to enter into any correspondence regarding any disqualification decision. The Promoter reserves the right to seek recovery of any Prize, or the value of any prize, already awarded to an Entrant who is subsequently disqualified where the disqualification results from fraud, misrepresentation, breach of these Terms and Conditions, or other intentional wrongdoing by that Entrant which caused or contributed to the Entrant being awarded the Prize.
10. Limitation of liability
10.1. Nothing in these Terms and Conditions limits or excludes the Promoter’s liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot be excluded or limited by applicable law. Subject to the exceptions set out in the preceding sentence, if the Promoter breaches these Terms and Conditions, the Promoter shall only be liable for loss or damage suffered by you that is a foreseeable result of such breach or of the Promoter’s negligence. Loss or damage is foreseeable if it is an obvious consequence of the Promoter’s breach or if it was contemplated by you and the Promoter at the time you entered the relevant Competition.
10.2. Subject to section 10.1, the Promoter shall not be liable for any loss or damage which is not foreseeable, nor for any indirect, consequential, special, or pure economic loss, including loss of profit, loss of opportunity, loss of chance or opportunity to win or be awarded any Prize, any anticipated or expected winnings, loss of anticipated savings, loss of goodwill, loss of business, or any disappointment, distress, or inconvenience, in each case whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise.
10.3. Subject to section 10.1, the Promoter shall not be liable for any delay in performing, or failure to perform, any of its obligations under these Terms and Conditions where such delay or failure results from a Force Majeure Event or from any circumstance otherwise beyond the Promoter’s reasonable control.
10.4. Subject to section 10.1, the Promoter shall not be liable for: (a) any loss, delay, failure, corruption, interception, or misdirection of any entry, communication, claim, notification, or transmission, whether electronic, postal, or otherwise, which is outside the Promoter’s reasonable control; (b) any interruption to, unavailability of, or technical malfunction affecting the Website, any payment system, telecommunications network, internet service, hardware, software, or any third-party platform or service used in connection with a Competition; or (c) any event referred to in sections 3.5.2, 3.5.3, or 10.3, except to the extent liability cannot be excluded by law.
10.5. Subject to section 10.1, the Promoter gives no warranty that the Website will be available continuously or without interruption, error, delay, or defect, or that it will be free from viruses or other harmful components. The Promoter further gives no warranty that any automated email notification sent pursuant to section 8.3 will be successfully delivered to the Winner, and shall not be liable for any failure, delay, or non-delivery of such notification arising from circumstances outside the Promoter's reasonable control. You are responsible for ensuring that Your registered email address is accurate and up to date and for using Your own appropriate software and systems protections.
10.6. Subject to section 10.1, the Promoter makes no representations or warranties in relation to any Prize, including as to quality, fitness for purpose, merchantability, value, description, condition, availability, or suitability, save to the extent expressly stated on the relevant Competition page of the Website or as required under applicable law.
10.7. Where a Prize is supplied, fulfilled, delivered, or otherwise made available by a Supplier or any other third party, the Promoter shall not, subject to section 10.1, be liable for any act, omission, default, delay, defect, or failure of that Supplier or third party, provided that nothing in these Terms and Conditions shall exclude or limit any rights you may have against the Promoter under applicable consumer protection law.
10.8. Subject to section 10.1, once a Prize has been delivered, collected, transferred, or otherwise made available to the Winner in accordance with these Terms and Conditions, risk in that Prize shall pass to the Winner, and the Promoter shall have no further responsibility in relation to the Prize, save as otherwise required by applicable law.
11. Force Majeure
11.1. For the purposes of these Terms and Conditions, a "Force Majeure Event" means any event or circumstance beyond the reasonable control of the affected party which prevents, hinders, delays or renders commercially impracticable the performance of any of its obligations under these Terms and Conditions, including (without limitation):
(a) acts of God, flood, storm, earthquake, volcanic activity, tsunami or other natural disaster;
(b) epidemic, pandemic or other public health emergency (including any governmental lockdowns, quarantines or travel restrictions);
(c) war, armed conflict, invasion, riot, civil commotion, insurrection, terrorist act or threat, sabotage or piracy;
(d) nuclear, chemical or biological contamination;
(e) explosion, fire or accidental damage;
(f) any act of any government or public authority (including the imposition of export or import restrictions, sanctions, embargoes or other trade restrictions, or any revocation or suspension of licences);
(g) strike, lock out or other industrial dispute (whether affecting Our workforce or any other person);
(h) interruption or failure of utility service (including power outage), telecommunications network, internet backbone, cloud hosting facility or data centre service;
(i) failure of or delay in subcontractors, suppliers or third party platforms (including app stores and payment processors) caused by any of the above; or
(j) any change in applicable laws, regulations, or regulatory requirements, including new or modified licensing requirements, permits, authorizations, or approvals required by any governmental or regulatory authority to conduct business operations; or
(k) any other cause or event of a similar nature, whether foreseeable or unforeseeable, that is outside the reasonable control of the affected party.
11.2. If a Force Majeure Event occurs, the affected party shall be relieved from the performance of the affected obligations for the duration and to the extent that performance is prevented, hindered or delayed. The corresponding obligations of the other party shall be suspended to the same extent.
11.3. The affected party shall: use reasonable endeavours to mitigate the effects of the Force Majeure Event on the performance of its obligations and to resume full performance as soon as reasonably practicable.
11.4. If the Force Majeure Event continues for a continuous period of thirty (30) days or more, either party may terminate the agreement constituted by these Terms and Conditions immediately on written notice to the other without liability, except for any rights or liabilities accrued up to the date of termination.
11.5. Where the agreement constituted by these Terms and Conditions is terminated under section 11.4, or where the Promoter otherwise permanently ceases to operate the Competitions such that reallocation of entries into one or more other Competitions is not possible, the Promoter will refund the entry fees paid to each Entrant via bank card refund (and, where an Entrant has made multiple entries, by way of a single consolidated payment). Entries submitted free of charge via the Postal Entry Route carry no monetary value, and no refund, compensation, credit, or other payment shall be due in respect of them. Following such refund, the Promoter shall have no further liability to the Entrant or to any other person.
11.6. This section 11 shall survive any termination or expiry of these Terms and Conditions.
12. General
12.1. The Promoter reserves the right to amend these Terms and Conditions from time to time. The most recent version of these terms and conditions will be made available on the Website. Where any amendment is material, the Promoter will use reasonable endeavours to notify active Entrants of the change by notifications on Our Website. Any amendment will not affect entries already submitted prior to the date the amendment takes effect. It is Your responsibility to check these TCs from time to time. You are encouraged to save a copy of these Terms and Conditions for Your reference.
12.2. Where there is reason to believe that a breach of these Terms and Conditions has occurred, the Promoter may, at its sole discretion, exclude you from participation in the Competition and any future Competitions.
12.3. Due to technical limitations, a maximum number of tickets may be added to a single cart. The minimum cart value applicable at checkout is set out in section 3.4.1(d).
12.4. The Promoter reserves the right to void, suspend, cancel, or amend the Competition at any time where circumstances beyond its control make such action necessary. Where a Competition is cancelled, the Promoter will reallocate each affected Entrant's entries (Paid or Free Entry) into another Competition on a proportional basis by reference to the value of the paid entries held by that Entrant, as determined by the Promoter in its reasonable discretion to a Competition of equal or greater value. If there are no other Competitions or if the Promoter ceases to hold any other Competitions, all paid Entries will be fully refunded to the same payment method used when purchasing the ticket(s). Postal Entries carry no monetary value and the Promoter shall not be responsible for any kind of compensation towards Postal Entries. Following such reallocation, the Promoter shall have no further liability to the Entrant or to any other person.
12.5. The Competitions on the Website are in no way sponsored, endorsed, administered by, or associated with Meta, Apple, or Google. By entering any of the Competitions, Entrants agree that Meta, Apple, and Google have no liability and bear no responsibility for the administration or promotion of the Competitions.
12.6. You are advised to print a copy of these Terms and Conditions and keep them for Your records.
12.7. KYC
12.7.1. We reserve the right to request identity verification from any participant at any time. Verification will ordinarily be required:
i. upon a participant winning a high-value Prize(s);

12.7.2. For the purposes of identity verification, we may require participants to produce:
i. a valid government-issued photo ID (passport or driving licence);
ii. proof of address in the form of a utility bill or bank statement issued within the preceding three months; and
iii. such further documentation as may be reasonably necessary to confirm eligibility, payment method ownership, or compliance with applicable law.

12.7.3. All documents must be valid, legible, and consistent with the registered Account details.
12.7.4. Where a participant fails to complete identity verification within five (5) calendar days following our request, or where verification is unsuccessful, we reserve the right to delay prize payments, suspend the relevant Account, and/or cancel any associated winnings. Game Nest Technologies LTD shall incur no liability in connection with the exercise of these rights.
12.7.5. All personal data collected in connection with our KYC process will be processed in accordance with our Privacy Policy and applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR).
12.8. Responsible Participation
12.8.1. Entrants may set a limit on the amount they spend over a chosen period (per day, per week, per month, or per year). At checkout, the Promoter will assess the Entrant's completed purchases within the current limit period and decline any transaction that would take the Entrant above the amount set. Any increase to, or removal of, a spending limit will take effect only after the applicable lock-until period has expired.
12.8.2. An Entrant may lock their Account for a set period of one (1) week, four (4) weeks, twelve (12) weeks, or one (1) year. During any such lock period, the Entrant may continue to log in and view their Account but will not be able to make payments or submit entries via the Postal Entry Route. The restriction will expire automatically at the end of the selected period.
12.8.3. Any complaint should be submitted by the Entrant to support@got2win.co.uk. The Promoter will consider each complaint and respond within a reasonable period.
13. Governing Law and Jurisdiction
13.1. These Terms and Conditions shall be governed by English law. Nothing in these terms and conditions, including this section, shall limit or affect an Entrant’s right as a consumer to rely on such mandatory provisions of local consumer law.
13.2. The courts of England and Wales shall have jurisdiction to hear any claims arising out of or in connection with these terms and conditions.

This information is provided in accordance with the respective External Account provider’s privacy policy and with Your consent at the time of registration. We do not receive or store Your External Account’s password.
2.3.2 When You register or log in via an External Account, We will receive and use certain information provided by the External Account provider at the point of registration or login (such as Your name, email address, and profile picture, if applicable) for the purposes of account creation, authentication, and provision of the application. We receive only the information that the External Account provider shares at the time You register or log in, in accordance with its own privacy policy and Your settings with that provider, and We do not have any ongoing access to, or control over, Your External Account. You may disconnect or revoke the connection between Your External Account and Our Services at any time through the External Account provider’s account settings, where available. We will not receive notification of any such withdrawal. If You disconnect Your External Account and later choose to log in using it again, the External Account provider may ask You to re-authorise the sharing of Your information; declining to do so may prevent or limit Your ability to log in or access the application through that External Account. In any event, any personal data already received from the External Account provider and stored within Your account will not be automatically deleted, updated, or altered as a result of such disconnection, and will be retained in accordance with this Privacy Policy. If You wish to request erasure of Your personal data, please refer to Section 5 (Your Rights).
2.3.3 By registering for Got2Win via an External Account:
i. You represent and warrant that all information provided through Your External Account is true, accurate, current, and complete, and You accept responsibility for keeping it up to date
ii. You acknowledge that We may rely on the information provided through Your External Account without obligation to verify its accuracy
iii. You agree that any loss or damage arising from false or inaccurate information is solely Your responsibility
iv. You acknowledge that disconnecting or revoking the connection between Your External Account and Our Services, or any suspension or termination of that account by the provider, may mean that, if You later attempt to log in using that External Account, You are asked to re-authorise the sharing of Your information, and that declining to do so, or the unavailability of that account, may prevent or limit Your ability to log in or access the Website through that External Account. Any personal data already received from the External Account provider and stored within Your account will not be automatically deleted, updated, or altered as a result, and will be retained in accordance with this Privacy Policy. If You wish to request erasure of Your personal data, please refer to Section 5 (Your Rights)

You can manage or disable non-essential cookies at any time through Your device or browser settings or through Our cookie preference centre. We will obtain Your consent before placing non-essential cookies in accordance with applicable law.
3. Purposes and lawful bases for processing Your personal information
3.1 We may use Your information for the following purposes. The lawful basis for each is indicated alongside:
i. To perform and deliver Our Services in accordance with Our Terms and Conditions
ii. To create and manage Your account, verify Your identity in connection with registration, and maintain the accuracy and security of Your account information
iii. To provide information on Your account, including transaction history, and activity trends
iv. To manage entries and purchases, facilitate draw participation, administer winner selection and notification, and enable other core interactive elements of Our Services
v. To process, verify and reconcile prize payouts to winners using the bank or payment account details provided by You, to resolve any related query or dispute, and to retain a record of the payout transaction in accordance with Our tax, accounting and other legal obligations (see clause 6)
vi. To prevent and detect fraud or other unlawful activities and to maintain the security and integrity of Our Services
vii. To comply with applicable laws and regulations
viii. To provide updates, new features, or promotional offers (with Your consent, which may be withdrawn at any time)
ix. To improve Our Services, analytics, and user experience
x. To maintain a secure connection between Our Services and Your device
xi. To take action against Users who violate any laws, regulations, or Our Terms and Conditions
xii. To respond to, manage, and resolve customer support enquiries and complaints
3.2 Where We process personal information to perform a contract with You, We may not be able to provide Our Services if You do not provide the necessary information. Where processing is based on consent, You may withdraw it at any time using the contact details below.
3.3 The following lawful bases apply to the processing activities described in clause 3.1:
3.3.1 Contract performance (Article 6(1)(b) UK GDPR): Processing Your personal data is necessary for the performance of a contract to which You are party, or in order to take steps at Your request prior to entering into a contract. This basis applies to: account creation and management; processing prize draw entries and purchases; administering draw participation, winner selection, and notification; and delivering the core features of the Services.
3.3.2 Legal obligation (Article 6(1)(c) UK GDPR): Processing is necessary for compliance with a legal obligation to which We are subject. This basis applies to: identity verification where required by law; fraud and crime-prevention obligations to the extent required by law; tax and accounting retention obligations; and compliance with applicable, advertising, and prize promotion regulations, including the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code) and requirements of the Advertising Standards Authority (ASA). In particular, the CAP Code requires Us, as promoter, to be able to confirm to reasonable enquirers that a draw has taken place and that a prize has been awarded, and to make available information identifying the winner upon request. Where We receive a request from the ASA or any other regulatory authority for winner information, that disclosure will be made on the basis of this legal obligation. Such disclosure is not subject to, and will not be limited by, any display preference selected by the winner under clause 3.4.
3.3.3 Consent (Article 6(1)(a) UK GDPR): Where We rely on Your consent as the lawful basis for processing, this will be clearly indicated at the point of collection. This basis applies to: marketing communications and promotional offers; non-essential cookies and tracking technologies; and any other processing for which We have specifically requested Your consent. You may withdraw consent at any time by using the contact details set out in Section 7 or by managing Your preferences within the Services. Withdrawal of consent will not affect the lawfulness of any processing carried out prior to withdrawal.
3.3.4 Legitimate interests (Article 6(1)(f) UK GDPR): Processing is necessary for the purposes of Our legitimate interests, or those of a third party, except where such interests are overridden by Your interests or fundamental rights and freedoms. This basis applies to: preventing and detecting fraud and misuse of Our Services and maintaining their security and integrity, beyond what is required by law; publishing winner information and reasonable publicity of prize awards to maintain transparency and public confidence in Our prize draws, as described in clause 3.4; improving Our Services, analytics, and user experience; enforcing Our Terms and Conditions; responding to customer support enquiries and complaints; and establishing, exercising, or defending legal claims. Where We rely on legitimate interests, You have the right to object as described in Section 5.
3.4 Winner Publication, CAP Code Compliance, and Publication Preferences. Where You win a prize through Our Services, We are required, as promoter, to comply with Our obligations under the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (the “CAP Code”) and any applicable requirements of the Advertising Standards Authority (the “ASA”). Those obligations include being able to confirm that a draw has taken place and that a prize has been awarded, and to provide information identifying the winner to reasonable enquirers or upon request from the ASA. In addition to those minimum obligations, We may also publish winner information (including, where applicable, the winning entry) on Our website or within the Services in order to maintain transparency and public confidence in the integrity of Our prize draws, on the basis of legitimate interests as described in clause 3.3.4. The underlying prize award process - including draw administration, winner selection, and notification - is carried out on the basis of contract performance under Article 6(1)(b) UK GDPR. To give winners meaningful control over how they are identified in any publication, We operate a tiered winner publication preference system, as described below. You may set or update Your preference at any time through Your account or by contacting Us using the details set out in Section 7.
The following display options are available to You:
(a) full name and location;
(b) first name and initial of surname, with location;
(c) initials and location; or
(d) anonymous participant and location.
Option (b) will apply as the default where You have not set a preference at the time of publication. Following a draw, results will be held in a pending state to give You the opportunity to set or update Your preference before publication takes place. Your selected preference will govern how Your details appear in any public-facing publication of winner information. Notwithstanding any preference You have selected, We remain entitled to disclose winner information - including Your full name and any other details reasonably required - to the ASA or any other regulatory authority upon request. Such disclosure is made on the basis of legal obligation under Article 6(1)(c) UK GDPR and will not be limited by the display preference You have selected.
Underlying winner records - including Your full name, contact details, prize details, and draw participation information - will be retained for as long as is necessary to: (i) administer the relevant promotion; (ii) satisfy any regulatory or legal obligations, including the ability to respond to requests from the ASA or other regulatory authorities; and (iii) establish, exercise, or defend any legal claims arising from the promotion. Retention is subject to the storage limitation principle under Article 5(1)(e) UK GDPR. Where records are no longer required for any of the purposes set out above, they will be securely deleted or anonymised in accordance with clause 6 of this Privacy Policy.
Any publication or disclosure of winner information will be limited to the details necessary to satisfy Our obligations as promoter and may include the winning entry (being the content submitted by You as part of Your draw entry, including any video, image, text, or other material), but will not include information such as Your full postal address, email address, or financial details. Where We wish to use Your name, image, likeness, photograph, voice, video recordings, biographical information, statements, social-media handle, testimonial, or any other personal details for advertising, marketing, promotional, or publicity purposes that go beyond the minimum required to evidence a valid prize award - including worldwide, in any media now known or later developed, and for a period of up to twenty-four (24) months from the date of the prize award (or such other period as specified at the point of consent) - for example, in advertising campaigns, on Our website, on social media, or in other promotional materials - We will seek Your separate, freely given, specific, and informed consent before doing so, save to the extent that such use constitutes reasonable publicity falling within Our legitimate interests as described in clause 3.3.4. You are under no obligation to provide such consent. Declining will have no effect on Your entitlement to any prize. Any such worldwide publicity use may involve transferring Your personal data outside the UK, in which case the safeguards described in clause 4.1 will apply.
Where We rely on legitimate interests as the lawful basis for publishing winner information, You have the right to object to that processing under Article 21 UK GDPR. You may exercise this right to object by updating Your display preference at any time by accessing Your account preferences or by contacting Us using the details set out in Section 7. We will consider any objection promptly and will cease processing on the basis of legitimate interests unless We can demonstrate compelling legitimate grounds that override Your interests, rights, and freedoms. However, where publishing or disclosing winner information is necessary to satisfy Our mandatory obligations under the CAP Code or to comply with a request from the ASA or other regulatory authority, that processing is carried out on the basis of legal obligation under Article 6(1)(c) UK GDPR and Your right to object will not apply to that element of the processing.
4. Sharing Your information and international transfers
4.1 We may share or transfer Your personal information with recipients located outside of Your country of residence. These recipients may include payment processors, other service providers described in clause 4.2, or affiliated entities that support the operation of Our Services. Where We transfer personal information internationally, We take appropriate steps to ensure that adequate safeguards are in place, such as UK adequacy regulations, UK International Data Transfer Agreements (IDTAs), or the UK Addendum to the EU Standard Contractual Clauses, in accordance with the UK GDPR.
4.2 We use service providers that process personal data on Our behalf (for example, IT, support, identity verification, or marketing providers), including where You provide information directly to them through Our Services. Such processors are bound by contractual obligations to keep Your information secure and to use it only in accordance with Our instructions.
4.3 Our Services may include links to social-media pages or external websites. These third-party platforms may collect information such as Your IP address or device ID and may set cookies. Please read their privacy policies before sharing any personal information, as We are not responsible for their data practices.
5. Your rights
5.1 Depending on applicable UK data protection laws, including the UK GDPR and the Data Protection Act 2018, You have the following rights in relation to Your personal data:
i. Right of access (Article 15 UK GDPR): You are entitled to receive a copy of the personal data We hold about You and information about how We process it. We will respond to a valid request within one (1) month of receipt. Where a request is manifestly unfounded or excessive, We may charge a reasonable fee or refuse to act, and will inform You accordingly.
ii. Right to rectification (Article 16 UK GDPR): You may request that We correct inaccurate personal data We hold about You or complete incomplete data, taking into account the purposes of the processing.
iii. Right to erasure (Article 17 UK GDPR): You may request that We delete Your personal data where it is no longer necessary for the purpose for which it was collected, where You have withdrawn consent and no other lawful basis applies, or where the data has been unlawfully processed. This right is subject to exemptions, including where retention is required for compliance with a legal obligation or the establishment, exercise, or defence of legal claims
iv. Right to restriction of processing (Article 18 UK GDPR): You may request that We restrict the processing of Your personal data in certain circumstances, including where You contest the accuracy of the data, where processing is unlawful but You oppose erasure, or where We no longer need the data but You require it for the establishment, exercise, or defence of legal claims.
v. Right to object (Article 21 UK GDPR): You have the right to object to processing of Your personal data where We rely on legitimate interests as the lawful basis, including profiling based on those interests. You also have an absolute right to object to processing for direct marketing purposes (including profiling related to direct marketing), and We will cease such processing upon receipt of Your objection. In respect of other processing based on legitimate interests, We will cease processing unless We can demonstrate compelling legitimate grounds that override Your interests, rights and freedoms, or unless the processing is necessary for the establishment, exercise, or defence of legal claims.
vi. Right to data portability (Article 20 UK GDPR): Where processing is carried out by automated means and is based on Your consent or the performance of a contract, You may request that We provide Your personal data in a structured, commonly used, and machine-readable format, and, where technically feasible, transmit it directly to another controller.
vii. Right to withdraw consent (Article 7(3) UK GDPR): Where processing is based on Your consent, You may withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing carried out prior to withdrawal. Where withdrawal of consent means We are unable to provide all or part of the Services, We will inform You of this at the time.
viii. Right to lodge a complaint (Article 77 UK GDPR): You have the right to lodge a complaint with the UK supervisory authority, the Information Commissioner's Office (ICO), if You believe that Our processing of Your personal data infringes applicable data protection law. The ICO can be contacted at: Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF; telephone: 0303 123 1113; website: www.ico.org.uk. We would, however, appreciate the opportunity to address Your concerns directly before You approach the ICO, and encourage You to contact Us in the first instance using the details set out in Section 7.
5.2 To exercise any of these rights or to withdraw consent for marketing communications, You may contact Us using the details set out in Section 7 below. We will respond to Your request without undue delay and in any event within one (1) month of receipt. We may request verification of Your identity before processing such requests. Please note that these rights are not absolute and may be subject to limitations or exemptions under applicable law, including where processing is necessary for compliance with a legal obligation, the exercise or defence of legal claims, or where an exemption under Schedule 2 of the Data Protection Act 2018 applies. We will notify You if We are unable to comply with a request and will explain the reason to the extent We are permitted to do so.
5.3 If You have concerns about how We handle Your information, We encourage You to contact Us first so that We can address Your complaint. You may also have the right to lodge a complaint with Your local data-protection authority.
6. Data retention and security
6.1 We retain personal information only for as long as necessary for the purposes described in this Policy. For example:
i. Account data (meaning the personal information You provide to create and manage Your account and that We generate in connection with Your use of Your account, such as Your name, contact details, login credentials, account preferences, and account activity, but excluding transaction records, bank and payment account details provided for prize payouts, and identity verification documents, which are retained in accordance with paragraphs (ii), (iii) and (v) below) is retained for the duration of Your account and for up to two (2) years after closure (or longer where required by law or regulations)
ii. Transaction and accounting records (including entry purchases, refunds, chargebacks, prize payments and payment references) are retained for up to six (6) years from the end of the financial year to which they relate, or longer where required by law or where relevant to an ongoing dispute or investigation.
iii. Bank and payment account details provided to receive a cash prize are retained only for as long as necessary to verify, process and reconcile the relevant payout and to resolve any related query or dispute, after which they are securely deleted. You may be asked to provide them again for any future payout. You may also ask Us to delete Your stored bank and payment account details at any time by emailing privacy@got2win.co.uk, subject to Our legal and regulatory retention obligations described in this clause 6. A record of each payout transaction (such as the payout amount, the account holder name, the payment date and the payment reference) will be retained as a transaction record in accordance with paragraph (ii) above.
iv. Fraud prevention and verification records are retained only for as long as reasonably necessary to prevent and detect fraud and misuse of Our Services, to carry out any related investigation, and to establish, exercise or defend legal claims
v. Identity verification documents and information, whether collected and checked by Us or by a third-party provider on Our behalf, are retained only for as long as reasonably necessary for the relevant verification purpose and any related dispute or investigation. Where possible, We retain only a record of the verification outcome and audit trail (for example, the date, method and result of the check) rather than the underlying document
vi. Customer-service communications are kept for three (3) years
vii. Marketing preferences are retained for two (2) years from Your last interaction
6.2 We may be required or permitted by applicable laws to retain certain data for longer periods (for example, for tax or accounting obligations, crime prevention, or the establishment, exercise or defence of legal claims).
6.3 When retention periods expire, We securely delete or anonymise the data in accordance with standard international data-protection practices, ensuring it cannot be recovered or reconstructed.
